The U.S. Equal Employment Opportunity Commission (EEOC) has, under Commission Keith Sonderling, taken the position that hiring platforms such as applicant tracking system (ATS) Workday and even job boards such as DHI Group’s Dice are liable under longstanding, anti-discrimination laws if they get into the process of screening and selection of candidates.
Staffing companies have long understood that they’re legally liable under those same laws, as did the employers who chose to work with those staffing companies. But now, if the EEOC’s position prevails, so are tech platforms such as ATS, job boards, assessment companies, and others…and the employers who choose to work with them.
